Supreme Court refuses stay on 0.4% UPI merchant discount rate framework

What happened

The Supreme Court of India declined to issue an interim stay on a 0.4% merchant discount rate for UPI transactions exceeding 2,000 rupees. While allowing the fee structure to take effect during litigation, the court agreed to review the underlying legal challenge and issued notices to the Indian government and the Reserve Bank of India.

Why it matters

Denying the stay allows payment networks and financial intermediaries to proceed with fee collection on qualifying transactions. However, the court's decision to hear the challenge leaves the long-term legal and operational framework for merchant charges uncertain while litigation proceeds.

Bigger picture

The case brings government authority over digital payment monetization under judicial scrutiny. A final ruling will establish legal boundaries for how Indian regulators can mandate or restrict transaction fees across the country's payment ecosystem.

Watch for formal court filings from the government and the Reserve Bank of India in response to the notices ahead of the Supreme Court hearings.
