India to prioritize cross-border insolvency framework and test group regulations

What happened

India plans to prioritize a cross-border insolvency framework while testing group insolvency regulations domestically. To support the rollout, the Ministry of Corporate Affairs is drafting guidelines to enhance coordination, build institutional safeguards, and expand professional capacity within the insolvency system.

Why it matters

Formalizing rules for cross-border debt and corporate groups aims to make complex restructurings more predictable. Clearer operational expectations provide domestic and foreign creditors with greater legal certainty when dealing with distressed firms.

Bigger picture

The initiative addresses key gaps in India's corporate insolvency architecture. Regulating multi-entity corporate groups and foreign assets is intended to improve systemic oversight and efficiency during large-scale corporate failures.

Watch next

The Ministry of Corporate Affairs' publication of finalized guidelines detailing coordination mechanisms, safeguards, and parameters for domestic group insolvency trials.
